RE: McKENNA, HORACE

SUBJECT: David Amos & Michael Woods Wired Conversation

BY: Orange County District Attorney's Office

DATE: October 27, 2000

LEGEND: *** Denotes unintelligible conversation.

(AT 1134 HOURS, AMOS WAS SENT INTO JERRY'S FAMOUS DELI, 21857 VENTURA BLVD., WOODLAND HILLS, CA., WEARING TWO LISTENING DEVICES. THIS TRANSCRIPT WAS TAKEN FROM THE MONITORED LISTENING DEVICE. THE DIGITAL LISTENING DEVICE WAS USED TO ASSIST IN COMPLETING THIS TRANSCRIPT)

AMOS: Well, actually you better ***. Go ahead. I don't want to say uh, uh, too much. *** Right. Right. Right. (UNINTELLIGIBLE CONVERSATIONS) (PAUSE) (AT 1222 HOURS, WOODS ARRIVED TO MEET WITH AMOS)
WOODS: Did you know they were at the clubs when you called me? You should have told me.
AMOS: I didn't want to say anything on the phone.
WOODS: Yeah, but Dave, they got the stuff out of the house. You know, I had to, I had some stuff laid out that I was gonna take out with me and you know...
AMOS: What, money?
WOODS: Some money there and, and uh, nothing bad in a way of paper work, you know, but I wanted to pull all my checking account stuff out like that. I could have done that easily.
AMOS: I didn't want to say anything to you over the phone.
WOODS: Oh. Oh. They know that you know so... you know what I'm saying? And uh, I don't think they're gonna come to the house. So I think they're going to the businesses to find proof of what they're looking for at the businesses and hopefully we're okay. You know, and you sit here and you rack your brains out and you say what are they gonna come up with.
WAITRESS: ***
WOODS: Can I get, ah, scrambled eggs with onions and tomatoes on the side and I'll take a small orange juice and a cup of coffee.
WAITRESS: And do you, do you want toast or bagel?
WOODS: Wheat toast.
WAITRESS: Okay.
WOODS: Yeah, because you know, this gives you an opportunity if you have any paper lying around and stuff like that. And you know, the other thing is, I left the house, Diane's not home. The dogs are home alone. I'm afraid they'll fuckin' go into the house and you know, the dogs *** a little bit and the cock suckers shooting them, you know.
AMOS: ***
WOODS: Um, I talked to Jack and I talked to the attorney and you know, bas... basically that, basically said cooperate, you know, that's all you could do. I got a hold of Jack and he talked to the attorney too. He's gonna go stop by the Valley Ball as a representative of the attorney, you know, just to see what's going on. And uh, uh, we should... I got to call the attorney back again. We should get them to call Orange County and uh, ask them ***. At least you know, read them the warrant. But they went into the Bare. I got a hold of Kyle.
AMOS: Yeah.
WOODS: I couldn't find... and you know, things like this happen, everything falls apart. Uh, Carl called me, said he got a strange phone call from James. But I was leaving the house to meet you. So you know, I tried calling the club and I didn't get an answer at the Jet, and I said "boy that's funny." I go, well, it's raining, their, their phone lines are down, you know. And then I tried the Bare and no answer there. And I tried to find, you know... and then I thought oh shit. And then I, I didn't have my phone list with me. So I thought that's bullshit, I'll try the Valley get them there... call Chip or James on their, fuck, you know, their cell phone. No answer at the Valley. I knew it then. So then I paged Kyle. Who called you?
AMOS: *** I saw some action and I pulled away. I was on my way down to the club.
WOODS: Oh, you saw it?
AMOS: Yeah. Went down that way from the uh, the marina, so I turned right around and went back to a public phone and that was it.
WOODS: And that's when you called me? Ah. Well, you should of told me. Yeah, I could have definitely got something out. It would have helped me out a little bit in case they do come to the house. I'm not really worried, but uh, I've got some stuff really buried at home, if they find that *** I mean it really is buried, I wouldn't have moved it any how.
AMOS: Why?
WOODS: Because it's really buried.
AMOS: Oh, well, I have a concern and I've got to ask you, I gotta ask you. *** years of relationship ***. If this shit hits the fan, where do I stand? If this shit hits the fan ***
WOODS: *** let me ask you a question Dave. Let me back you a little bit, okay. So I'm not confused here. What do you want me to say? Tell me what you want me to say? You know...
AMOS: You're talking too loud.
WOODS: Okay. Tell me what you want, want me to say.
AMOS: I want to know...
WOODS: I want to trust you 100%.
AMOS: Now look, if I take the fall for you, what are you gonna do? Are you gonna...
WOODS: Yes, Dave.
AMOS: One... one minute. You gonna look after my family?
WOODS: Yes.
AMOS: You gonna look after me while I'm away?
WOODS: Dave, you know, I want to tell you something and I... you know, I haven't said this, but you've been saying things and I have been just closing my eyes and not saying anything. I know a lot of the stuff you've been saying about me lately, with this money stuff and some of this and that, I admit it to you. And believe me, you know when you hit, when you hit me with it, I admitted it to you and I admitted more than you know. And then all of a sudden, you were looking at more. And you're coming back and hitting me with stuff and I'm telling you right now, a lot of this stuff that you're telling me that I did, if you and I sat down I could show you that I didn't do it. If you remember correctly, I was pulling most of my money out of the business in rent.
AMOS: Yes.
WOODS: And you, you hit me with the fact that I was doubling up your rent back in, you know, the mid 90's. And I wasn't doing that. I was pulling most of my money as rental income if you remember correctly. You know, and your guys are saying, oh, he beat you out of all this money and he ran and he did this and he did that. A lot of that stuff I did not do. I just want to let you know. I mean I'm not telling you I didn't take some stuff from you, but you know, once you hit me with it, I was up front with you about it.
AMOS: One second, up front about what, ***?
WOODS: No, once you, once you hit me ***
AMOS: About the rent?
WOODS: No.
AMOS: ***
WOODS: No, Dave. I was, I, I was up front... well, actually not. But I was up front with you... I mean when you, when you asked me if I was doing anything, I didn't deny anything to you. I told you I did and...
AMOS: Yeah, but you were caught with your hand in the cookie jar. It was over, there was nothing to deny.
WOODS: Well, hate to say it. It was more like being caught standing next to the cookie jar the way you were looking at it at first.
AMOS: Yeah, of course, what I'm saying is...
WOODS: No.
AMOS: ...it was right there.
WOODS: What I'm trying to tell you Dave, I mean you know, without, without out going into a bunch of semantics and stuff like that, is I have tried to be up front with you. I mean, you know, you know, once you found the thing, then I came clean on, on everything is what I'm trying to tell you. But some of the stuff...
AMOS: But what I'm afraid of...
WOODS: I'm not gonna do it to you.
AMOS: No, what I'm afraid of, when this shit comes down, alright, Johnny rolls, I've taken the fuckin' fall and you walk away.
WOODS: No Dave, I won't do it, okay.
AMOS: I have your word on that?
WOODS: Yes, yes, David I won't do it.
AMOS: I tell you, I found out something last night.
WOODS: Okay.
AMOS: I found out when I talked to Johnny, that Johnny had a driver. I never knew that.
WOODS: *** Johnny had a...
AMOS: Johnny had a driver. He had a driver when he went down to do Mac.
WOODS: Oh.
AMOS: He had a fuckin' driver.
WOODS: (LAUGHS)
AMOS: You think that's funny? I'm on the fuckin' ***
WOODS: No because I mean Dave, If something comes down and someone said *** and why did I do this for you, you know, why did I give you the thing, I'm gonna go back to the same old story like we've always said. Who the fuck else was I gonna get to do it? You know. Who else was I gonna get to run the business for me, my brother? You know, Dan Sully didn't want to be bothered. You know, uh, Chip or James who don't have any balls, you know, I mean I'm gonna stick to my original story, you know, I was scared to death. I went and got a prescription for Valium from my doctor because I was having panic attacks. You remember that? You know. I thought someone was going to come and kill me. You know? I didn't want to go by the fuckin' clubs. So I say, hey Dave, you go, you run the clubs, I'll split it with you. You know. And that's the story I'm gonna stay with.
AMOS: You're gonna stick with that?
WOODS: Uh-huh.
AMOS: I think, I think Johnny... uh, I think you were right about Johnny. I think he's unsteady.
WOODS: Right.
AMOS: And I think you were right. He shouldn't, he shouldn't be around but he is.
WOODS: Right. Now.
AMOS: ***
WOODS: Not only that, I wanted a meeting today to find out if you had met with him.
AMOS: I did meet with him.
WOODS: But the other thing I wanted to say was this. The phones are tapped.
AMOS: You sure?
WOODS: Well, I'm not positive, okay. But, that meeting yesterday with Jack and Frank, when you think about that, that was a bullshit meeting. That was completely bullshit. And Jack and Frank called me as soon as they heard from these guys and, and you know, these are the guys supposed to *** sharp and they said too much over the phone. You know, and I realized that when they hung up and you know, it's kind of hard to stop them when they are talking on the phone. And so I realized after they hung up that if these, the phone was tapped, these guys knew that they had called me and they had some information and blah, blah, blah. When they, they whey went, when they went to them yesterday and said we'd like to talk to Mike and Dave, they could of called the attorney. They know who our attorney is. Why should they set up some fuckin' meeting with Jack and Frank and go about all this subterfuge?
AMOS: Yeah, I think you got a point.
WOODS: You know, cause our attorney would say no. Jack and Frank go back to our attorney and our attorney says no.
AMOS: I'm a little bit worried about Johnny.
WOODS: Oh, yeah, yeah.
AMOS: You know, he wants more money.
WAITER: Are you finished?
AMOS: Can I get some strawberry jam? Strawberry jam, please.
WAITER: ***
AMOS: Oh, thank you. I'm sorry, I didn't see it. My mistake. He wants money.
WOODS: Number one, if you give him any right now, it's an admission. You know what I'm saying? You give them anything right now it's an admission. If, if he's wired or something like that.
AMOS: What should I do?
WOODS: I would stall him. He doesn't need it right away. I would stall him. And even if he did... you know what I'm saying? Even if everything was okay with him and you gave it to him and they found out that he got money all of a sudden they would, they would be suspicious. I mean just got twelve five. *** because I mean I know all along he being, ***. He's in the end of the line with them. You know what I'm saying? He's breaking it off with you. *** you need to say, hey Johnny, "I'm fuckin' tapped right now." You *** you just fuckin' pulled this fucking money out ***. If you can be patient, live on what you got for now and you know.
AMOS: *** No, ***
WOODS: *** then just say "I can't ***"
AMOS: He'll never buy it.
WOODS: He'll what?
AMOS: He'll never buy it. Why can't I get it from Mike, I can't get it from him.
WOODS: Johnny, he doesn't know a fuckin' thing about ***.
AMOS: He knows, he knows you do. He knows *** there's no way, there's no way I would have come up with $25,000 dollars and just laid it out there.
WOODS: Well... man alive.
AMOS: He knew that. He put it together. I didn't have that kind of cash.
WOODS: If you give him the money and he's wired or, or... he doesn't even have to be wired. If you just hand him the money and he goes and, and goes back to them and shows them that you gave him the money, you know... I mean, you want to tell him anything, and you wanna, you say, "Johnny, you can't come over *** they just hit my house." You know *** you know and just say, you're just gonna have to be patient. Fuck that shit when you lend him a damn thing ***
AMOS: Oh, it ain't that, but I just see, I just see it that he ain't gonna believe it and if he doesn't believe it, if I don't get the money then all of sudden it's like Mike's fucking with you. ***. You know how he gets. He thinks you don't like him anyway.
WOODS: Right. And the thing I've always been under the impression and I have to be stupid to admit. I was always under the impression that he didn't know that it came past you.
AMOS: You with the money. He's a sharp kid. He may be a little nuts sometimes, but he's sharp.
WOODS: Well, he may think that, you know what I'm saying, he may think, but he has no idea. You see what I'm saying? Unless, you have to ad..., you know what, the thing is this. What he's saying and it's just like these guys that are running the case, they have all these theories. They've got to come up with proof to prove it. You may have a theory, but as long as you don't prove it to them... are you, are you following me? And I mean, you can turn around and I mean *** money and say hey Johnny, I'm gonna fuckin' tell you, I begged, borrowed and stole the fuckin' money from anybody I could. And you could name Joe Isgro, and you can name any fuckin' body you want.
AMOS: Joe Isgro?
WOODS: I mean, I'm saying Johnny, you can name anybody. You can say I borrowed it from any fuckin' body I could. A little bit here, a little bit there because I know...
AMOS: Oh, way back then?
WOODS: Yeah, way back then because I knew that if something came down...
AMOS: Right, I already tried that, he knows, he knows too fuckin' much. He knows you and you know him. And that's just it, that's why you two don't see eye to eye. You could see right through it. *** He was, he was pissed. ***
WOODS: We should go outside. ***
AMOS: *** outside places. He was pissed uh, a while ago. I might have given him some more money because he reminded me and he blames you all along cause when he had to keep his mouth shut after the whole thing, he'd get some extra money for keeping his mouth shut and he didn't get for all those years. And that's just like fuckin' Mike, he fucked up and didn't give it to me.
WOODS: Well, I hate to say this, but you're the one... you told me you would take care of Johnny.
AMOS: I know. I thought he forgot about it. I mean you said you'd do it and I forgot to give it to him, is what happened.
WOODS: *** but the thing is...
AMOS: I mean he can't prove it's you.
WOODS: Yeah.
AMOS: Put it that way.
WOODS: But the thing is, you can't... I mean, you can talk to him, you can say, Johnny, you're sharp enough to know, you are sharp enough to know I can't come up with money right now. I cannot come up with fuckin' money right now. And then that's, that's really what you're gonna say to him. Cause I'm telling you Dave, if they've got him in a, in a... you know what I'm saying, if they've already got him and you give him the fuckin' money right now and he demanded it from you as a pay off, you are fucked. You are absolutely, positively fucked. Oh, yeah, you didn't have anything to do with this? Then how come this came up with this money? You follow me?
AMOS: I wonder where they're gonna go next? They're gonna start talking to um, whoever. It doesn't stop here. I wonder what's next? They seize anything at the clubs, or they, they ***
WOODS: Well, what they're doing now and I have to say this and it makes me feel a little bit better, okay. They're, they're going to the clubs for the book work, okay. I mean you and I should go outside and go for a walk. Ah, or go for a drive or something. But it makes me feel a little bit more comfortable because when they go to the clubs they're looking for evidence of the bank records.
AMOS: There ain't much of that anyway.
WOODS: I know it. And if that's what they're doing that's fine. You know what I'm saying? And then I'd feel a little bit more comfortable about Johnny. Are you comfortable with what he told you?
AMOS: No.
WOODS: No. That...
AMOS: He mentions money. Uh, he mentions he wants some money. Ah, He mentioned he had a driver. You know what I mean? These things...
WOODS: Right. Yeah, the driver makes you feel very uncomfortable.
(CELLULAR TELEPHONE RINGS)
WOODS: *** Listen, keep in touch and I'll, I'll either call you or page you. Uh, yeah. Yeah. I think ***. *** Well, what the're doing now they should of done three years ago with the search warrants ***. Okay, I'll see you. Thanks. Bye. They haven't gone to my house. Kyle said they were talking to Chip about their investigation into Mac's death and tax evasion. It makes me feel a lot better. *** feel a lot better. Because if they're still doing the tax evasion that means they don't have shit on the other thing. They don't have shit on the other thing. You know... ***

*** If you think that's more of a hard call ***

AMOS: ***
WOODS: Alright, thanks. I'll keep in touch. Um, *** That was Vickie, the attorney from the office. I don't think you met her. She's working with him on the case, Uh, She said she wasn't able to get a hold of anybody at the club. Uh, she says she doesn't think they'll come to the houses.
AMOS: No?
WOODS: She said because, um, well, she said this stuff they should of done ages ago. If they had their acts together and they were looking for evidence, why go and investigate for three years, you know, let us know what they're doing and you know, we got three years to prepare. Hopefully, we have, and then you know, all of sudden come to the house or come to the clubs with search warrants looking for stuff. Now I don't see, I don't see where they're going to find much at the clubs. Kyle said Chip wouldn't talk to them. They were advising Chip of his rights and Chip said "I desire not to talk to you." Well, we could advise you of your rights, take you down town and he said "okay."
AMOS: *** paperwork ***
WOODS: Yeah. It makes me feel better on this thing with Johnny. But you gotta stall him.
AMOS: ***
WOODS: *** You gotta you know, you gotta stall him, because it's it's a really bad situation ***. If we could get, if we could at least get through the weekend. If we could at least get through the weekend we'll be okay.
AMOS: How so?
WOODS: Because if you get through the weekend, you'll know if they'll have a warrant, warrant for you or I. If they have a warrant for us, we're in deep shit. ***. I mean they may or they may be holding them, but the fact that they didn't come to our houses, you know, I don't know if you got anybody at home or not. But you should have your dad go over to your place.
AMOS: I have no reason to be ready.
WOODS: You know, well the only reason you should have him go there is to make sure that they don't ***. *** I mean you saw what happened the last time.
AMOS: My place, yeah.
WOODS: Yeah. ***
AMOS: Hold on let me get the phone. ***
AMOS: Oh no. That's Jack's ***
WOODS: Ah, what's his name, the guy with the *** Randy Jones?
AMOS: Yes.
WOODS: We'll definitely need him to go to all of the club offices and stuff. If not him, someone else after the guys leave.
AMOS: Okay. ***
WOODS: Alright. Um,... Yeah, this thing yesterday that proved it to me. This thing yesterday with Jack and Frank. They were gonna do something else. They were gonna do something else and then... because they said, Jack and Frank said to me on the phone that would be highly improper of them to contact them because they're, they're investigators working for my defense attorney, you know. And so when they show up they say, well, the reason we want to talk... I mean you know, him.... but the reason we want to talk you is we would like for you to arrange to have Mike and Dave talk to us. What's improper about that? Nothing.
AMOS: No.
WOODS: Nothing at all, you know. And then, and then they make the comment about you know, uh, the money laundering and, ah, tax evasion and stuff and ah, you know, what's the big deal. You know?
AMOS: ***
WOODS: No.
AMOS: But, let's let's talk outside about that.
WOODS: Right.
AMOS: *** talk some more about that.
WOODS: You didn't pay yet, did you?
AMOS: Oh, no.
WAITRESS: *** no I don't have it, she does.
AMOS: Oh.
WAITRESS: ***
AMOS: Oh, thank you.
WOODS: Actually one, one last thing I did before coming was run to the bank and deposit some money in the bank. I had those checks. I thought I may need a, I may need a check, I may need money. Um,... have you, uh, I haven't myself, but have you made any arrangements for a bail bondsman?
AMOS: No.
WOODS: Lance has got a guy that we could do it with pretty easily. So um, I got to call Lance when we get out of here. I'm gonna have to get you Lance's number cause he's got a bail bondsman. Because, like if they book us on something, you know, they may set a million dollar bail or something like that. He can do one of two things, he could either put up property which would delay it a little bit and you have to stay in jail over the weekend or if they set the bail right away, you know, uh, you write a check to the bail bondsman for 10% of whatever they, hell the bail and kiss it good bye. You know, in talking to Lance, he said Mike, in the long run he said if it costs you 300,000 to a bail bondsman, he said that's gonna be the least of your uh, legal expenses. I don't, I don't think I.... I'm not saying this to spook you, but I'm gonna tell you this. Uh, if it goes so far, okay, and you get arrested, I will have the business pay for your legal expenses. You know? And this is between you and I, if, the business will loan you the money based on your shares of stock. If someone comes back and says something, you know. It won't be, you know what I mean, it won't be an unsecured loan, it'll, it'll look like I'm protecting myself. Follow me?
AMOS: But you will be.
WOODS: Yeah. But on the other hand, on the other hand, I have to say this too. I think if they want so far as to arrest you, they'd arrest me. You don't know who the driver was?
AMOS: No.
WOODS: Could that be bullshit?
AMOS: I don't think so. He didn't look like he was. He seemed real concerned, then he wanted... wanted money. So I didn't know if he wanted it for the driver, for himself or whatever.
WOODS: Well, did you ask him if he's been talking to his uh, handler?
AMOS: What did you say?
WOODS: Has Johnny been talking to his buddy?
AMOS: Oh, his buddy told him that, that uh, Tony Barry is out in the witness protection.
WOODS: I know that.
AMOS: But uh, I asked him "who you talking to ***?"
WOODS: A lot of this stuff, I think a lot of this stuff they're doing right now and, and the search warrants don't surprise me. I mean you know, I'm not sitting here and I'm all excited, and my heart's racing or anything. I expected this search warrants. You know I said this to you. That they'll come up with bullshit search warrants and you know, that doesn't bother me. The only thing that bothers me is there's a driver. That's what bothers me.
AMOS: And why does that bother you more than Johnny?
WOODS: More than John? I think he has a lot of loyalty to you. I mean I still do. I don't like it and I don't like him... for that, but *** you know what I mean? I mean, worst case scenario, maybe it's Tony Barry, you know what I mean? *** no fucking idea who it is. *** and, ah, it's like something like I said to you long ago. As long as you have that out there you got to be careful that they don't do something, you know. They get something thrown at them and they all of sudden they go, hey, g-bing, g-bing, g-bing. Let me ask you a question. The other piece of equipment, did it get thrown away? I mean this evidence.
AMOS: What piece?
WOODS: The weapon.
AMOS: The weapon?
WOODS: The one that was used.
AMOS: *** John? No, I didn't throw it away.
WOODS: Oh.
AMOS: He did. I never saw it. I didn't even know what it was till I read in the paper. Still didn't know exactly what it was.
(CELLULAR TELEPHONE RINGS)
WOODS: *** Okay, they had U.S. Treasury guys with them.
AMOS: What's that?
WOODS: They had U.S. Treasury agents with them.
AMOS: ***
WOODS: I got to get back home. My thinking is I'm gonna pull every fucking check book I have in the house. I mean they may have, if they got the U.S. Treasury, they may have gotten some real good stuff, you know? As far as any checking accounts I may have, you know. But I mean you know, the only, the only thing you need to remember on this is I was looking for that tape of today. The only thing to remember is you do not fuckin' talk to them. Nobody talks to them. You know? And you got to convince Johnny of that. You have nothing to say, you know. Nothing to say. Exactly what they're doing with Chip. You don't want to talk to us, well, if you don't want to us, we're gonna advise you of your rights. Okay, fine. Advise me of my rights.
AMOS: That's just messing with them. The boys haven't done anything wrong. It's really...
WOODS: Right.
AMOS: You and I they want.
WOODS: Yeah, yeah.
AMOS: Well, they want me to roll on you.
WOODS: Yeah. And I don't know how, I mean really I don't know how they got the treasury involved. I mean they... and that's how they know about the loan and I told you. *** See they didn't have anybody from the Treasury's office. The *** got along with them. They may be taking them along with them and see if they could find anything. And they may have contacted the Franchise Tax Board. The Franchise Tax Board said "no thanks, we've been that route before." You know? And just cause they have the Treasury doesn't mean anything. It doesn't mean a fucking thing. It just means that they brought them along. But Jack said that's real inconvenient. He went to the Valley, he went to the Valley. ***

Yeah, let's go outside ***

AMOS: I'm going to use the restroom first, thanks, Mike, hey Mike, Mike. I'm gonna go to use the restroom.
WOODS: *** they just follow you and follow you *** two of us together.
AMOS: ***
WOODS: I'll have to say one thing, it certainly does make you want to void your body.
AMOS: ***
WOODS: *** making you want to void your body.
AMOS: What's that mean?
WOODS: You know, take a piss...
AMOS: Oh, yeah.
WOODS: and things like that.
AMOS: Yeah, I urinate a lot anyway.
WOODS: Yeah... The other time they were at the house, I must have shit five fucking times while they were there that time.
AMOS: ***
WOODS: Ah, that's what I was saying, *** you know, ah, actually, Stuart spoke up pretty good for us about that deal, because I never saw Stuart when he died. *** I understand you went and brought a shotgun and protected yourself, and I had fuckin' diarrhea and stuff, but that was all bullshit, you know. Um, I couldn't stop fucking shaking when he died. I remember that, I just couldn't fucking believe it, but, ah, no, when they came to my house with the search warrants is when I had, ah, you know, I went and took five or six shits. I didn't have diarrhea, but I just kept going to the bathroom. I'm going "ah, man I can't believe this another shit, another shit." They were there like four and a half hours and within that period of time, I shit five or six times.
AMOS: What are you driving?
WOODS: A Ford.
AMOS: How do you like it?
WOODS: It's alright. Actually, I felt a little bit comfortable driving it because it's probably a vehicle they don't know yet. Did you send you dad over to your place?
AMOS: Ah, no I didn't want to tell him yet.
WOODS: Yeah, but you know what, it doesn't hurt if they're making moves.
